On May 14, 2020, Governor Ron DeSantis issued Executive Order 20-121 – “Limited Extension of Mortgage Foreclosure and Eviction Relief”. This Order extends the current moratorium on mortgage foreclosures and evictions for non-payment of rent until June 2, 2020. The original Executive Order Number 20-94 was set to expire on Sunday, May 17, 2020.
The Executive Order 20-94 and 20-121 specifically suspend and toll residential evictions for nonpayment of rent. The Executive Orders do not toll or suspend residential evictions for any other reason. The Executive Orders also do not suspend commercial evictions.
What this Means:
The Executive Orders do not stop a Landlord or Property Owner from evicting a Tenant for reasons other than a Tenant’s failure to pay rent. For example, a Landlord or Property Owner may evict a Tenant for failing to comply with a material provision of the rental agreement (other than a failure to pay rent), such as destruction, damage, or misuse of the Landlord’s or another Tenant’s property.
